Terms and Conditions for Rajagiri

What is Telemedicine?

Telemedicine involves the use of ICT (Information and Communication Technology) to enable doctors at different locations to share individual patient medical information, for the purpose of improving patient care. A teleconsultation is based entirely on the information furnished i.e., text data, laboratory values and images.

Though Telemedicine is highly beneficial to patient, the possible limitations are

  • Due to technical reasons, there may be an interruption during the tele-consultation.
  • Due to network conditions, at times the quality of transmission may be suboptimal, resulting in postponement of the tele-consultation.
  • The teleconsultant gives an opinion based on the physical examination and findings of the primary doctor (RMP – registered medical practitioner).
  • The teleconsultation may be videotaped, digitally recorded, filmed or photographed and used for training and audit purposes. The patient’s identity will not be revealed.
  • Patient Consent to the Use of Telemedicine
  • I have read and understood the information provided regarding telemedicine (translated to a language which I understand). I hereby give my informed consent for the use of tele-consultation service for my medical care.
  • I solemnly affirm that I will provide information that is true and complete to the best of my knowledge and belief.
  • I agree that Rajagiri Telemedicine Services, the tele-consultants, doctors at the remote centers and all personnel directly or indirectly involved, in any part of the Telemedicine set-up, will not be held responsible, in the unlikely event of an error in diagnosis or management, due to the occurrence of sub optimal technical conditions. While every attempt will be made to ensure ideal conditions, “unforeseen situations may occur”.
  • I promise to follow the telemedicine prescription under the supervision of the primary doctor (RMP)
  • I agree to subject all disputes arising out of this consultation to subject matter of Kochi, India Jurisdiction

Patient Consent to the Use of Telemedicine

  • I have read and understood the information provided regarding telemedicine (translated to a language which I understand). I hereby give my informed consent for the use of tele-consultation service for my medical care.
  • I solemnly affirm that I will provide information that is true and complete to the best of my knowledge and belief.
  • I agree that Telemedicine Services, the tele-consultants, doctors at the remote centers and all personnel directly or indirectly involved, in any part of the Telemedicine set-up, will not be held responsible, in the unlikely event of an error in diagnosis or management, due to the occurrence of sub optimal technical conditions. While every attempt will be made to ensure ideal conditions, “unforeseen situations may occur”.
  • I promise to follow the telemedicine prescription under the supervision of the primary doctor (RMP).
  • I agree to subject all disputes arising out of this consultation to subject matter of Kerala, India Jurisdiction only.

PRIVACY POLICY

  • Use of the App.

You may use the App for the purpose of receiving Rajagiri telemedicine services and medical care. You agree to provide accurate and complete information when using the App. You must also comply with all applicable laws and regulations when using the App.

  • User Accounts.

To use the App, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information and for any activity that occurs under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

  • Ownership and Intellectual Property.

The App and its contents are owned by QuikDr and its licensors, and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App or its contents without our prior written consent.

  • Limitation of Liability.

In no event shall Rajagiri telemedicine or its affiliates, officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App or its contents.

  • Indemnification.

You agree to indemnify and hold harmless Rajagiri telemedicine and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the App or your breach of these Terms.

  • Modifications to the App and Terms.

We reserve the right to modify or discontinue the App or these Terms at any time without notice. Your continued use of the App after any modifications to these Terms constitutes your acceptance of the modified Terms.

  • Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of [Arbitration Association]. The arbitration shall take place in Kochi, Kerala.

  • Termination.

We may terminate your use of the App at any time for any reason without notice. Upon termination, you must immediately cease all use of the App and its contents.

When you use the App, we may collect the following information:

  • Health information you provide to us, such as medical history, symptoms, and other health-related information
  • Information about your use of the App, including device information, log information, and location information

  • To provide you with telemedicine services and medical care
  • To improve and develop our App and services
  • To communicate with you about our services and promotions
  • To comply with legal requirements and regulations.
3. How We Share Your Information

We may share your information with third parties in the following circumstances:

  • With your consent
  • With our service providers who assist us in providing the App and our services
  • With healthcare professionals who provide medical care to you through the App
  • In response to a subpoena or other legal process
  • To protect our rights or the rights of other.

 4. Data Retention and Security

We will retain your information for as long as necessary to fulfil the purposes for which it was collected, or as required by law. We implement reasonable security measures to protect your information from unauthorized access and use.

 5. Children’s Privacy

The App is not intended for use by children under the age of 18. We do not knowingly collect personal information from children under 18.

6. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on the App. Your continued use of the App after the changes have been made will constitute your acceptance of the new Privacy Policy.
